试论加大对行贿罪的惩罚及立法完善

摘要: 贿赂犯罪作为社会腐败的一大恶源，严重侵犯了国家公职人员职务行为的廉洁性,
因此，对于贿赂罪，无论是受贿罪还是行贿罪都应当受到严厉打击，然而在我国的司法实
践中相对于受贿罪的处罚而言,对行贿行为追究刑事责任的却很少见,这一方面是因为我国
刑法在政策上存在重受贿轻行贿的不合理现象,另一方面我国现行刑法所设定的行贿犯罪
的构成要件也值得商榷,同时现行刑法三百九十条规定的行贿罪的刑事责任太笼统,缺乏可
操作性.本文拟对这一问题作一点探究，以“抛砖引玉”，促进学界对这一问题研究的深
入。

Increasing the penalization of bribery
and the perfect of legislation

Abstract: Briber crime which was recognized as a big source of corruption
Infringed upon the Incorruption of the officer-hold of our country seriously,
Therefore , Not only the accept-bribes ,but also the bribery should be
penalized, but in our country’s judicatory, compared to the penalization of
bribees, we hardly penalize the bribers. I think there are two reasons, First,
our criminal take the strategy of belittling bribing and making much of
accept-bribes. Second, the structure of bribery is not reasonable, and the
390th item of our criminal is too illegible, It is lack of the quality of
operation. This essay intend to do some investigation on this problem, with
the hope of “throw the brick lead the jade ”,in order to promote the
investigation to deeper .
