Abstract
The judicial independence is one of the basic principles of the judicial system of most countries in western countries and even world. Judicial independence is the guarantee of just judicial system. Article 126 of current constitution of our country stipulates: ¡°the people's court administers justice independently according to the legal provisions, is free from any inference by administrative organ, public organization and individual ¡±, article 131 stipulates: ¡° the people's procuratorate exercises the right of procuratorial work independently according to the legal provisions, is free from any inference by administrative organ, public organization and individual ¡±. But the fact is not like this . This text will proceed with historical origin of the judicial independence, describe the intension of the origin, development, judicial independence of the judicial independence, and the state of the judicial independence at present of our country, will start to write or draw from the countermeasure of providing finally.
