摘 要
中国从近代引入了著作权制度，并从20世纪80年代开始实施。长期以来，著作权人的权利受到漠视，利益遭侵犯甚至被剥夺。
加入WTO及签署 TRIPS协议之后，中国必须对侵犯著作权的行为加大打击的力度，其中包括行政处罚，特别是民事诉讼程序。
本文全面介绍了著作权侵权形态，侵权归责原则、侵权赔偿的范围以及赔偿的具体计算方式等等。

英文摘要
Abstract
The copyright system was introduced into China from the modern times and put into practice since 1980's. In a long time the author's copyright is brushed aside,the benefit is randomly encroached,even bereaved.
After affiliating the WTO and subscribing the TRIPS Agreement, China must increase the hitting strength,including punishment and especially the common pleas procedure,to the action of encroaching the author's copyright.
This paper entirely introduces the forms of encroaching the author's copyright,the principles of how to confirm the encroacher's responsibility, the extension of the encroacher's ameds ,the mode of counting amends and so on.

加入WTO及签署 TRIPS协议之后，中国必须对侵犯著作权的行为加大打击的力度，其中包括行政处罚，特别是民事诉讼程序。
我国从近代引入了著作权制度，并从20世纪80年代开始实施。长期以来，著作权人的权利受到漠视，利益遭侵犯甚至被剥夺。由于对著作权的了解不足，在司法实践中，对是否构成著作权侵权，侵权的赔偿标准怎样，各地法院的标准并不是很一致。
本文将从著作权侵权形态，侵权归责原则、侵权赔偿的范围以及赔偿的具体计算方式等方面对著作权侵权赔偿问题进行全面的分析。
