    The Transition of Modern Society and the Development
    of the Discourse of Field Law

    Abstract The discourse of field law appears in the historical backgrounds of the upgrading of national governance, in which the simple modernity which advocates individualism, negative rights and generalization have caused many social problems, thus advancing the historical stage of reflecting on and re-constructing modernity, along with the transformation of liberal state under the rule of law to social state under the rule of law. Based on this transition, lots of legal phenomena have become difficult to be covered by the sectoral legal system because of the new ideas, functions and contents, leading to anxiety in positioning and limited development. In view of this, the field law in terms of cognition and methods expands and surpasses the traditional legal branch, remedy imperfection facing legal problems in emerging fields, thus coexisting in the legal practice. The paradigm of the field law highlights concrete and substantive justice spirit and the social standard, and keeps the applicable way from the conceptual center to the issue orientation, from the abstract subject to the personality of legal roles, from skipping the facts to paying attention to the facts, from single value to multi-coordination, and from system closure to inter-disciplinary integration, so as to promote the development of people and the society.
