On Advance Mortgage Registration of Buildings under Construction

Abstract:Through the object of the buildings under construction,determining the nature of the mortgage contracts of these buildings and discussing the common problems of advance mortgage registration of buildings under construction in China,this paper draws the conclusion that the corresponding right holder of advance mortgage registration can have a claim for the mortgage registration of the buildings when the construction is finished in the future.Thus they can lay the basis for the mortgage registration of the constructed buildings and enjoy the preferential compensation from selling off the mortgaged buildings when the mortgager fails to fulfill his obligation.
